Participation
By participating, each participant (hereinafter: “participant”) accepts these conditions of participation and any special conditions of participation or rules of the competition that may be announced.
The special conditions of participation or rules such as period and prize are stated directly in the posting text on the official Kakao Mischa social media channels.
Participation after the closing date stated in the posting text is not possible. The electronically recorded time of receipt of the data on the meta server is decisive.
After the designated competition period has expired, the winner will be determined by lottery from all participants submitted and will receive the prize after being informed.
- Non-cash prizes cannot be paid out or exchanged for cash.
- Each person may only take part in the competition once.
- The prize is personal and non-transferable.
- The participant must be of legal age, i.e. 18 years of age.
- The participant must be registered with his/her place of residence in the Federal Republic of Germany.
Kakao Mischa employees and their relatives and domestic partners are excluded from participating in the competition.
Exclusion from the competition
In the event of a violation of these terms and conditions or in the event of manipulation of the competition, Broadway reserves the right to exclude anyone from the competition. In any case of exclusion, winnings can also be subsequently withdrawn or winnings that have already been delivered can be reclaimed.
Implementation and processing
The winner(s) will be chosen at random and then notified by tagging them in the Instagram story on the Instagram channel @kakaomischa.
Kakao Mischa is not liable for notifications from fake profiles.
Kakao Mischa is not liable for late delivery of prizes or loss of prizes in the post.
The winner is responsible for the accuracy and completeness of his or her own address details. Incorrect information may result in delivery not being possible at all or being delayed. Broadway cannot guarantee multiple delivery.
A cash payment of the winnings is excluded.
Early termination of the competition
Kakao Mischa reserves the right to cancel or end the competition at any time without prior notice and without giving reasons and without awarding the prizes.
Kakao Mischa makes use of this option in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, proper implementation of the competition is prohibited or cannot be guaranteed can.
If such termination is caused by the behavior of a participant, Kakao Mischa can demand compensation for the damage caused from this person.
In addition, this person can be excluded from the raffle in accordance with Section 3 of the Conditions of Participation and Implementation.
Liability
Kakao Mischa is released from all obligations when the prize is handed over, unless an earlier point in time arises from these regulations.
If termination according to §4 is caused by the behavior of a participant, Kakao Mischa can demand compensation for the damage caused from this person.
Subject to Section 5, Paragraph 4, the organizer is not liable for material and/or legal defects in the prizes.
Kakao Mischa is only liable for damage caused by Kakao Mischa intentionally, grossly negligently, through any culpable injury to life, body and/or health or through any culpable breach of cardinal obligations, the proper fulfillment of which is essential for the legal relationship with the participant and on whose proper fulfillment the participant can rely.
Liability for breach of cardinal obligations is limited to typical and foreseeable damages. This limitation of liability also applies to Kakao Mischa’s vicarious agents or other vicarious agents.
Liability under the Product Liability Act remains unaffected.
data protection
The data submitted by participants when participating will be stored exclusively by Kakao Mischa for the entire duration of the competition and will only be used for the organizational implementation of the competition.
After the competition has ended and the prizes have been sent, the data will generally be deleted within 14 days.
Each participant is free to give their consent (Article 6 Paragraph 1 Letter 1 Point (a) GDPR) to the storage and use of their data at any time, for example by email to herz@kakaomischa.de. to revoke. In this case, participation in the competition is excluded.

The recipient of the information provided is not Meta, Facebook and Instagram , but Kakao Mischa. All questions, comments or complaints about the competition should be directed to Kakao Mischa. Kakao Mischa reserves the right to change or adapt the terms and conditions of the competition at any time without notice or to cancel the competition/raffle completely.
Miscellaneous
Legal recourse is excluded.
Only the law of the Federal Republic of Germany is applicable.
If individual provisions of these terms and conditions of participation are or become invalid, the validity of the remaining provisions remains unaffected.
The conditions of participation can be changed by Kakao Mischa at any time without separate notification.
