The following terms and conditions apply to the organization of a Kakao Mischa Gathering by third parties (hosts).
§ 1 Subject Matter
Kakao Mischa Gatherings are collaboratively organized events aimed at fostering community, heart connection, and cacao culture in cooperation with Kakao Mischa. These events are carried out by voluntary hosts ("organizers") on their own responsibility and based on a shared foundation of values.
The values that shape our collaboration include appreciation, curiosity, courage, compassion, and trust. These values must be strictly upheld when hosting a Gathering.
§ 2 Role of Kakao Mischa
For the event, Kakao Mischa provides a 30% discount on 500g cacao blocks from the available product range on the kakaomischa.de webshop, free random affirmation cards, and shared experiences. However, there is no entitlement to remuneration, support, or assumption of liability by Kakao Mischa.
§ 3 Event Framework
Event Location
The event location can be freely chosen by the organizers, whether by renting a suitable space or by holding it in their own living room.
Participant Responsibility
The number of participants is also flexible and determined by the organizers themselves, with full responsibility for conducting the event resting with them.
The organizers are responsible for communicating with participants, obtaining relevant data (e.g., allergies, health information), and complying with data protection guidelines.
Content
The focus of the Gathering is on conducting a communal cacao ceremony. It is expressly emphasized that the hosting individuals should have experience in conducting a cacao ceremony. Kakao Mischa cacao must be used in the ceremony itself – it is not permitted to use or promote cacao from other cacao manufacturers.
The design of the event, including its length, further activities, and the overall framework, is the responsibility of the organizers.
Profit
The "Kakao Mischa Gathering" event should not be profit-oriented. It is up to the organizers to charge a fair price from participants. This should not exceed the incurred costs by more than 20%.
§ 4 Liability
The Gathering is conducted on one's own responsibility. Trust in the diligence of the organizers is crucial. Kakao Mischa assumes no liability for personal injury, property damage, or financial losses in connection with the event.
Organizers assure to independently review and comply with all applicable laws and any requirements (e.g., noise protection, right of assembly). They act with courage and responsibility to legally frame the event correctly.
§ 5 Use of Materials & Communication
The name "Kakao Mischa Gathering" may be used in the context of the event, provided this is in line with the brand's values.
Image and video material created during the Kakao Mischa Gathering may be provided to Kakao Mischa for publication. The rights remain with the creator, but use by Kakao Mischa for marketing purposes is permitted after consultation.
For the use of image and video material, the express consent of all depicted persons is required. The organizer is responsible for this.
Use of Templates and Own Image Material
Organizers are obliged to ensure that no third-party copyrights are infringed when using their own images, graphics, or promotional materials.
Kakao Mischa will provide organizers with selected graphics, logos, and templates for promoting the Kakao Mischa Gathering upon request. These may be used in connection with the event as long as they are not altered or used in a misleading way.
Kakao Mischa assumes no liability for the use of unlicensed or unlawful content by organizers.
§ 6 Quality Assurance and Approval
Application Process
Applications to host a regional Kakao Mischa Gathering are made via an online form. Kakao Mischa reserves the right to reject applications for individual Gatherings if they do not align with the values mentioned above or the brand's objectives.
Therefore, the hosting of a "Kakao Mischa Gathering" may only take place after explicit written approval from Kakao Mischa.
Communication
After the application, a contact person from the Kakao Mischa team will promptly get in touch with the organizers to arrange a short call and clarify any open questions.
After the event, Kakao Mischa invites the organizers to a second discussion. In this discussion, both parties reflect on the event, exchange pictures (if available), provide valuable feedback, and gather ideas on how Kakao Mischa can further improve its offerings.
Should any complaints arise from participants during the event, the organizers commit to informing Kakao Mischa in a timely manner. Our concern is transparent, solution-oriented, and appreciative communication.
Withdrawal & Cancellation by Organizers
Should a previously approved Gathering need to be cancelled for personal or organizational reasons, Kakao Mischa must be informed immediately. Re-application for future Gatherings is generally possible, but we reserve the right to suspend participation in the event of repeated short-notice cancellations.
If the event does not take place, no compensation or refund will be provided by Kakao Mischa.
§ 7 Participation in the Ambassador Program
Organizers must participate in the Kakao Mischa Ambassador Program and will receive an individual discount code and cacao credit for new referrals. Details can be found in the separate terms and conditions of participation.
§ 8 Final Provisions
These conditions are deemed accepted upon application to host a Kakao Mischa Gathering. Amendments must be made in writing.
Insurance: Organizers are obliged to ensure adequate insurance coverage (e.g., liability insurance) that covers any risks associated with the event.
Confidentiality: Organizers commit to treating all confidential information received within the scope of their cooperation with Kakao Mischa as strictly confidential and not to disclose it to third parties.
Code of Conduct: Organizers commit to structuring events in a respectful, safe, and inclusive manner. All participants should be able to express themselves freely and without discrimination. Organizers are expected to actively work towards respectful and mindful conduct during the Kakao Mischa Gathering.
